1. Terms of Reference
 For the purposes of the terms and conditions herein, the term:

“Organizer” refers to  AsiaEvents Exsic Sdn Bhd

“Conference” refers to the ASIA DIVE CONFERENCE (ADCon) 

 “Event Venue” refers to Putra World Trade Centre, Kuala Lumpur, Malaysia

“Conference Date” refers to 29 July 2016.


2. Application for Conference
The submission of the Conference Registration Form shall be deemed as an acceptance of the terms and conditions herein by the delegate. The application procedure is complete only when the Conference Registration Form and payment are received by the Organizer.

3. Payment
a)      Full payment is required with your Conference Registration Form submission. Confirmation of registration is only upon receipt of full payment. Conference fees include :

i)  admission to Conference sessions, lunches, coffee breaks, certificate of attendance, registration materials to Single day only.

ii) admission to Conference sessions, lunches, coffee breaks, certificate of attendance, premium gift, registration materials and entrance to  Dinner with speakers (Applicable for full day registration only).

b)      Payment must be made in full upon submission of the Conference Registration Form. 

c)      Payment may be made by online payment mode only via credit card and online banking that is available at registration page at ADCon website.

d)      The Organizer is not responsible for covering any airfares, lodging or incidental costs incurred by delegates.

e)       The Organizer reserves the right to review and amend the currency exchange rate as applied therein when necessary.

4. Cancellation/Postponement of the Conference
a) If, for any reason, the Conference, or any part thereof, is prevented from being held, or the Event Venue becomes unavailable the Organizer may cancel or postpone the Event. In such event, provided the delegate has paid the payments for the Conference, the said payment may be used for a future Conference organized by the Organizer. No refunds, part refunds or alternative offers shall be made. The Organizer shall not be responsible for delays, damage, loss, increased costs, or other unfavorable conditions arising by virtue thereof, and the delegate(s) waive(s) claims for damage against the Organizer arising therefrom.

b) If the delegate is unable to attend the Conference, a substitute delegate is welcomed at NO extra charge provided written notification is given to the Organizer no later than one month before the event date.

c) For cancellation, a refund minus 40% administrative charges will be sent to the delegates if cancellation is received on or before two months before the event date. No refund will be made for cancellation received thereafter.

5. Change of Conference Date, Speakers, Programme Content and Venue
The Organizer reserves the right to change the Conference Date, speakers, programme content and Event Venue should circumstances so require.

6. Refusal of Admission
The Organizer reserves the right to refuse admissions or remove any person from the Conference at its absolute discretion, without incurring any liability whatsoever. This will include anyone deemed drunk, disorderly, under the influence of drugs, other than that medically prescribed, or whose dress appearance or general  behavior is liable to disturb any delegates or persons attending the Conference.

7. Venue Regulations
The delegate(s) shall abide by the Rules and Regulations of the Event Venue. Failure to comply with the Rules and Regulations will constitute grounds for breach of the terms and conditions herein. A copy of the Rules and Regulations may be obtained from the Organizer.

8. Breach of Terms and Conditions
In cases where the delegate(s) fails to observe and perform any of the terms and conditions herein,  the Organizer shall reserve the right to refuse performance of all its obligations herein towards the delegate(s) and all fees paid by the delegate(s) to the Organizer will be forfeited. The delegate(s) shall furthermore indemnify the Organizer for all losses and damages resulting from such failure in observing or performing the terms and conditions herein.

9. Exclusion of Liability
The Organizer, its sub-contractors, agent and/or employees have the right to immediately alter or cancel the Conference or any arrangements, timetables, plans or other items relating directly or indirectly to the Conference. The delegates shall not be entitled to any compensation for damages that result from such alteration or cancellation. Furthermore, neither the Organizer, its sub-contractors, agent and/or employees shall at any time be liable for any loss, damage or injury whatsoever , howsoever suffered by any of the delegate(s) or any loss or damage to property of any delegate(s) arising form or in connection with his/her participation in the Conference.

10. Force Majeure
The Organizer shall not be liable for any delay or failure to perform its obligations under the terms and conditions herein due to circumstances beyond the control and without the fault or negligence of the Organizer including war (declared or undeclared), natural disaster, acts of God, fire, blockades, earthquakes, acts of terrorism and matters beyond the Organizer’s reasonable control.

11. Interpretation, Governing Law and Jurisdiction
Interpretation of the terms and conditions herein lies solely with the Organizer. The terms and conditions herein shall be governed by and construed according to Malaysian law. The parties hereto hereby agree to submit to the exclusive jurisdiction of the Malaysian courts.

12. Successors in Title and Lawful Assigns
The terms and conditions herein shall be binding upon the parties, its successors in title and lawful assigns.

13. Intellectual Property Rights
All intellectual property rights in all trademarks, logos relating to ADCon and to the Organizer and materials produced and/or distributed by the Organizer in connection with this Conference is expressly reserved and any unauthorized use, duplication, publication and distribution is strictly prohibited.

14. Dress Code
Please note that the dress code for ADCon is casual smart/business attire. Delegates who do not adhere to this policy will be denied entry into the Conference Venue.

15. Promotional materials
By submitting the registration form for ADCon, the delegate is indicating his/her consent to receiving marketing messages from the Organizer and its business partners unless the delegate has indicated an objection to receiving such messages by informing the Organizer in writing.

16. Notice under the Personal Data Protection Act 2010 (“PDPA”)
The Personal Data Protection Act 2010 (“PDPA”) which regulates the processing of personal data in commercial transactions applies to Organizer.  For the purpose of this notice, the terms “personal data” and “processing” shall have the meaning prescribed in the PDPA.

  1. To administer the registration of delegates for ADCon;
  2. To develop a database of delegates.
  3. To send the delegate further information or to keep the delegate updated on the next ADCon and any other conferences or events or products that the delegate may be interested in.
  4.  The delegates’ personal data may be transferred to a place outside Malaysia. 
  5.  The delegates hereby consent to the processing of their personal data in accordance with all of the foregoing.

Submission of an online registration is regarded as a firm booking (subject to availability) and acceptance of these terms and conditions. Cancellation charges will apply for all bookings.
